Although clinical ethics consultation is a high-stakes endeavor with an increasing prominence in health care systems, progress in developing standards for quality is challenging. In this article, we describe the results of a pilot project utilizing portfolios as an evaluation tool. We found that this approach is feasible and resulted in a reasonably wide distribution of scores among the 23 submitted portfolios that we evaluated. We discuss limitations and implications of these results, and suggest that this is a significant step (...) on the pathway to an eventual certification process for clinical ethics consultants. Clinical ethics consultation is largely outside the scope of regulation and oversight, despite its importance. For decades, the bioethics community has been unable to reach a consensus on whether there should be accountability in this work, as there is for other clinical activities that influence the care of patients. The American Society for Bioethics and Humanities, the primary society of bioethicists and scholars in the medical humanities and the organizational home for individuals who perform CEC in the United States, has (...) initiated a two‐step quality attestation process as a means to assess clinical ethics consultants and help identify individuals who are qualified to perform this role. SummaryUtah has the highest total fertility of any state in the United States and also the highest proportion of population affiliated with the Church of Jesus Christ of Latter-day Saints. Data were used from the 1996 Utah Health Status Survey to investigate how annual household income, education and affiliation with the LDS Church affect fertility for married women in Utah. Younger age and higher education were negatively correlated with fertility in the sample as a whole and among non-LDS respondents. Income (...) was negatively associated with fertility among non-LDS respondents. However, income was positively correlated with fertility among LDS respondents. This association persisted when instrumental variables were used to address the potential simultaneous equations bias arising from the potential endogeneity of income and fertility. This paper investigates the effect of the countervailing forces within organizations of formal systems that direct employees toward ethical acts and informal systems that direct employees toward fraudulent behavior. We study the effect of these forces on deception, a key component of fraud. The results provide support for an interactive effect of these formal and informal systems. The effectiveness of formal systems is greater when there is a strong informal “push” to do wrong; conversely, in the absence of a strong (...) push to do wrong, the strength of formal systems has little impact on fraudulent behavior. These results help to explain why the implementation of formal systems within organizations has been met with mixed results and identifies when formal systems designed to promote ethical behavior will be most efficacious. Researchers from across the social sciences have found consistent deviations from the predictions of the canonical model of self-interest in hundreds of experiments from around the world. This research, however, cannot determine whether the uniformity results from universal patterns of human behavior or from the limited cultural variation available among the university students used in virtually all prior experimental work. To address this, we undertook a cross-cultural study of behavior in ultimatum, public goods, and dictator games in a range of (...) small-scale societies exhibiting a wide variety of economic and cultural conditions. We found, first, that the canonical model – based on self-interest – fails in all of the societies studied. Second, our data reveal substantially more behavioral variability across social groups than has been found in previous research. Third, group-level differences in economic organization and the structure of social interactions explain a substantial portion of the behavioral variation across societies: the higher the degree of market integration and the higher the payoffs to cooperation in everyday life, the greater the level of prosociality expressed in experimental games. Fourth, the available individual-level economic and demographic variables do not consistently explain game behavior, either within or across groups. Fifth, in many cases experimental play appears to reflect the common interactional patterns of everyday life. As in other societies, medical professionalism in the Peoples’ Republic of China has been rapidly evolving. One of the major events in this process was the endorsement in 2005 of the document, “Medical Professionalism in the New Millennium: A Physician Charter,” by the Chinese Medical Doctor Association (hereafter, the Charter). More recently, a national survey, the first on such a large scale, was conducted on Chinese physicians’ attitudes toward the fundamental principles and core commitments put forward in the Charter. Based (...) on empirical findings from that study and comparing them to the published results of a similar American survey, the authors offer an in-depth interpretation of significant cross-cultural differences and important transcultural commonalities. The broader historical, socio-economic, and ethical issues relating to salient Chinese cultural practices such as family consent, familism (the custom of deferring decisions to family members), and the withholding of medical information, as well as controversial topics such as not respecting patients’ autonomy, are examined. The Chinese Survey found that Chinese physicians supported the principles of the Charter in general. Here we argue that Chinese culture and traditional medical ethics are broadly compatible with the moral commitments demanded by modern medical professionalism. Methodologically and theoretically—recognizing the problems inherent in the hoary but still popular habit of dichotomizing cultures and in relativism—a transcultural approach is adopted that gives greater (due) weight to the internal moral diversity present within every culture, the common ground shared by different cultures, and the primacy of morality. Genuine crosscultural dialogue, including a constructive Chinese-American dialogue in the area of medical professionalism, is not only possible, but necessary. (shrink)

Malcolm Acock attempts to show that three widely accepted “solutions” to the philosophical problem of theory choice between the ordinary account of the age of the universe, and “Russell's hypothesis” that the world sprang into existence five minutes ago, are unsatisfactory. In the following paper we shall attempt to show why “Russell's hypothesis” is defective as a cosmological explanation of the age of the universe.

That humans can categorize in different ways does not imply that there are qualitatively distinct underlying natural kinds or that the field of concepts splinters. Rather, it implies that the unitary goal of forming concepts is important enough that it receives redundant expression in cognition. Categorization science focuses on commonalities involved in concept learning. Eliminating makes this more difficult.

The claim that nature is self-consistent has recently been contested by a number of paraconsistent logicians. In this paper I will survey the arguments which paraconsistent logicians have presented for the thesis that nature is actually inconsistent. My conclusion is that these arguments all fail.The paraconsistency programme has to date been concerned primarily with outlining the philosophical inadequacy of classical logic, and detailed discussions of issues bearing upon the philosophical adequacy of the paraconsistency position itself are not to be found (...) as yet in the literature. Demographic characteristics of atheists in Canada, Mexico, and the US based on the World Values Survey are also examined. What life is like for atheists in the US, including the discrimination they experience and the issues they must address in developing an atheist identity (...) in a predominantly religious country, are also detailed. Our capabilities in space are growing almost as fast as our ambitions. Many nations, companies, and private actors are currently vying to secure historic “firsts” in space, raising complex social and ethical questions. There is surprisingly little serious analysis of these issues, however, and they are rarely discussed in undergraduate class discussions, despite their popularity with students. To help correct this deficit, a student research team designed 11 case studies to help instructors across the curriculum introduce space into their classes. (...) Following the International Women's Year in 1975, a group of men and women met every month for a year at the home of psychoanalyst Edith Weigert to reflect on what was then called the "psychology of women." Recently, a few members of that original group, joined by several others, began a seminar on gender and psychoanalysis with the goal of reexamining old and new writings infeminism, psychoanalysis, and related fields. We begin this response by discussing the selfishness axiom and the importance of the preferences, beliefs, and constraints framework as a way of modeling some of the proximate influences on human behavior. Next, we broaden the discussion to ultimate-level (that is evolutionary) explanations, where we review and clarify gene-culture coevolutionary theory, and then tackle the possibility that evolutionary approaches that exclude culture might be sufficient (...) to explain the data. Karl Popper introduced the idea of verisimilitude to explicate the intuitive idea that a theory T2, even though it is strictly speaking false, may be closer to the truth than a competitor T1. However, as is now well known, the results of Pavel Tichý, John Harris and David Miller establish that on Popper’s qualitative theory of verisimilitude, a theory T2 could be closer to the truth than another theory T1 only if T2 contains no false sentences. This result has been (...) taken universally to show the inadequacy of Popper’s original account of verisimilitude, since the Miller-Tichý-Harris Theorem conflicts with the very basic intuition which first led Popper to formulate his theory.In this paper I shall first review the Miller-Tichý-Harris Theorem and examine a number of attempts to salvage the concept of verisimilitude. It will be argued that none of these attempts is successful. Finally an alternative, simple and intuitively satisfactory account of verisimilitude will be offered. This account will be along the lines first suggested by Popper, but it is not subject to any known limitation theorem. Further, the account is capable of giving verisimilitude orderings between not only scientific theories, but philosophical theories as well. This will be achieved without the use of the excessive formalism which dominates the contemporary verisimilitude research programs. (shrink)

Background: Neurotypical young adults show task-based modulation and stability of their eye movements across tasks. This study aimed to determine whether persons with aphasia (PWA) modulate their eye movements and show stability across tasks similarly to control participants. Methods: Forty-eight PWA and age-matched control participants completed four eye-tracking tasks: scene search, scene memorization, text-reading, and pseudo-reading. Results: Main effects of task emerged for mean fixation duration, saccade amplitude, and standard deviations of each, demonstrating task-based modulation of eye movements. Group by (...) task interactions indicated that PWA produced shorter fixations relative to controls. This effect was most pronounced for scene memorization and for individuals who recently suffered a stroke. PWA produced longer fixations, shorter saccades, and less variable eye movements in reading tasks compared to controls. Three-way interactions of group, aphasia subtype, and task also emerged. Text-reading and scene memorization were particularly effective at distinguishing aphasia subtype. Persons with anomic aphasia showed a reduction in reading saccade amplitudes relative to their respective control group and other PWA. Persons with conduction/Wernicke’s aphasia produced shorter scene memorization fixations relative to controls or PWA of other subtypes, suggesting a memorization specific effect. Positive correlations across most tasks emerged for fixation duration and did not significantly differ between controls and PWA. Conclusions: PWA generally produced shorter fixations and smaller saccades relative to controls particularly in scene memorization and text-reading respectively. The effect was most pronounced recently after a stroke. Selectively in reading tasks, PWA produced longer fixations and shorter saccades relative to controls, consistent with reading difficulty. PWA showed task-based modulation of eye movements, though the pattern of results was somewhat abnormal relative to controls. All subtypes of PWA also demonstrated task-based modulation of eye movements. However, persons with anomic aphasia showed reduced modulation of saccade amplitude and smaller reading saccades, possibly to improve reading comprehension. Controls and PWA generally produced stabile fixation durations across tasks and did not differ in their relationship across tasks. Overall, these results suggest there is potential to differentiate among PWA with varying subtypes and from controls using eye movement measures of task-based modulation, especially reading and scene memorization tasks. This book is a lively, readable sequel in which Lycan answers critics and extends the homuncular functionalist view of consciousness given in his 1987 Consciousness, also published by MIT Press. Both books aim to defend a materialist view of human beings by countering nonmaterialist accounts of consciousness, subjectivity, qualia, and sensation. The original line of defense, behaviorism, gave way to identity theory which was followed by functionalism. Identity theory refers to the “ type-type” identification of the mental with the neurophysiological. (...) It argues that mental states are inner and mediate between stimulus and response. “They are states of the central nervous system, describable in neuroanatomical terms”. Functionalism sees identity theory as “an empirically special case of Functionalism... that locates all mental states at the same very low level of institutional abstraction—the neuroanatomical”. Since the early seventies, when English translations of Jürgen Habermas’ principal works became available to English-speaking scholars, there has been a virtual “Habermas explosion” of research papers, dissertations and books. Informative and penetrating discussions already exist discussing Habermas’ encounter with positivism and his relationship to the “Frankfurt school.” There are however few detailed discussions of the theoretical relationships between Habermas’ project of a critical theory of society and Hegel’s system. We attempt to correct this previous omission in the following paper.The (...) central thesis of Jürgen Habermas’ Knowledge and Human Interests is that theoretical discourse is fundamentally tied to human experience. Habermas wishes to show that all theoretical statements about the world have their genesis in the experience of everyday life and practices. His particular understanding of this approach to the question of the possibility of knowledge has its origins in Hegel’s Phenomenology of Spirit. The Phenomenology defines the development of knowledge in terms of a science of experience and must therefore constitute the main text in locating the philosophical parameters of Habermas’ thought. Our paper is an exercise in hermeneutics addressed to this task.In rejecting both Hegel’s philosophy of identity and Marx’s ontology of nature, Habermas has forced himself into a position where he must elaborate exactly how knowledge is possible at all. That is, the question which he confronts concerns the underlying basis of human experience. Hegel and Marx in Habermas’ opinion, were both unsuccessful in developing an adequate account of human life precisely because they tended to give an absolute basis to the the structure of the world. Knowledge itself, was considered as knowledge of something which existed beyond the scope of human control. Habermas attempts to overcome these difficulties by developing an explicitly ontological account of man through his theory of cognitive interests. Thus the process of reflection is ‘guided’ by certain cognitive interests. These interests perform the same function in Habermas’ system as does the notion of Geist in Hegel’s or Nature in Marx’s. They determine the conditions by which ‘knowledge’ can be generated and thus constitute the grounds upon which our world-view is constituted. (shrink)

The following frank comments on the subject of analysis, though they obviously represent a preliminary examination af some of the problems that emerge between philosophical analysis and phenomenology as the two major trends in contemporary philosophy, are conceived by the present author in a much broader manner than the mere confrontation of two apparently opposing schools of thought. Due to the emergent nature of these themes, some adagio, others allegro, it has been impossible to arrange them in the usual systematic (...) manner. Whatever in these comments is "offensive" to either phenomenologist or analyst derives from the fact that this is only a preliminary study, in which the author is orienting himself and preparing for more systematic and thorough-going dialogue with sympathetic analyst friends and phenomenologist critics. What is presented here to friend, foe, and general philosophical reader, is a selection of themes that have puzzled me greatly. I offer them without any of the usual excuses and with the hope that to some extent this discussion may bring philosophers together, so that we can begin to lind the common ground, on which to make our contribution to contemporary thought the more truly convincing. Is a simple refinement of the way we are living sufficient to address the environmental crisis? Is a wise use stance in which we produce and consume 'smarter' enough? This work not only answers no to the above question, but argues that a new way of life is already emerging---an ecological way of life. The ecological way of life is centered conceptually upon the ethical ideas first formulated in various policy documents, namely, that we are responsible to future generations in (...) terms of sharing this planet. The obligation to future generations follows from the formation of a new kind of transgenerational community that differs significantly from both immediate descendants and the posterity models for such communities. The reference to future generations undercuts the traditional US-THEM distinction and opens up a future-to-come in opposition to a future-present. The 'otherness' of future generations is emphasized with the result that our task is one of living within a disciplined not-knowing. This transgenerational community formed around future generations provides a framework for the ecological way of life by providing the ethical context for such environmental obligations as the precautionary principle. ;Given that the reference to future generations undercuts the traditional motivation provided by an US-THEM distinction, the experiential dimension of the environmental movement comes to the fore. How can people be motivated to sacrifice for those that come after, especially as they are not immediately identified with an Us? I examine an existential arena I labeled as 'living in the woods'. This space is an over-determined space of exile from the dominate culture that not only allows for social critique, but through the rediscovery of 'natural' rhythms and the experience of the beauty of a particular, provides an embodied experience of biophilia and of the earth as the fragile and vulnerable home of future generations. Not everyone has to 'life in the woods', but these experiences and reflections do provide, much as religious life in the monastery, an intense and articulated paradigm of a way of life for others. ;Finally, this dissertation was written for an intelligent, lay audience. The interconnections among environmental policies, political dynamics, and ethical concerns are all examined. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:92 A NOTE ON SMITH'S TERM "NATURALISM" The reader of contemporary Hume literature may feel exasperated when reading recent authors. A conspicuous example is A.J. Ayer (Hume, 1982; see index, Art, Natural beliefs), who declares they endorse Kemp Smith's view of Hume's "naturalism" without sufficiently clarifying what they — or Smith — might exactly mean by this term. Charles W. Hendel, in the 1963 edition of (...) his 1924 Studies in the Philosophy of David Hume, adds eight pages of a new preface and thirty-one pages of a review of Hume scholarship between 1925 and 1962, and he speaks at great length there of his life-long friendship and cooperation with Norman Kemp Smith and appreciation of his work. He says (p. xlviii), "There is a disposition today to assimilate Hume's thought to naturalism as understood in the contemporary sense." He does not say what this "contemporary sense" is, and the statement just quoted seems to have served as the seal of approval and the legitimation of this questionable practice. Hendel's new, 1963, material mentions Smith's discussion of Hume's "naturalism" — but refers only to Smith's early work, "The Naturalism of Hume," Mind, 14, 1905, 149-173 and 335-347, not to Smith's famous The Philosophy of David Hume of 1941, even though he deems that work "of great consequence for Hume scholarship" (p. xxxviii) and a "masterwork" (p. xxxix). The early work (1905) of Smith is already mentioned by Hendel in the body of the 1924 work (p. 361), although there, clearly, the word "naturalism," whatever its meaning is, and however contemporary then, is not necessarily the "contemporary sense" of 1962. The work which clearly (if implicitly) distinguishes between the traditional sense and Smith's 1905 sense of "naturalism" is John Laird's Hume's 93 Philosophy of Human Nature, 1932, 1967. We find there a discussion of Hume's naturalism (beginning of Chapter II), as well as of Hume's "Naturalism" (Chapter VI, fifth and fourth paragraphs from the end), with reference to Smith's 1905 work. Now, the traditional sense of "naturalism" is straightforward and seems to have been instituted by Pierre Bayle to designate the view of the world as devoid of all supernatural intervention, the view of the world as "disenchanted," to use the equivalent term accredited to Max Weber. Clearly, all Epicureans and neoEpicureans, Hume included, were naturalists in this sense. This is not the sense in which Smith uses it in his 1905 essay, "The Naturalism of Hume." The first part of this essay opposes T. H. Green's traditional reading of Hume as a philosopher who streamlined the ideas of Locke and Berkeley and proposes to replace it with the view of Hume's view as "naturalism." "Hume's... naturalistic view of reason," we are told (p. 158), "is a new theory of belief": Humean belief, on Smith's new reading, "is not caused by knowledge but precedes it, and as it is not caused by knowledge it is not destroyed by doubt" (p. 165). Smith declared his reading quite revolutionary, yet it may be endorsed without rejecting Green's reading. Smith does not even attempt to re-interpret in detail the passages which prima facie conform to Green's reading. The second part of his essay is the application of his revolutionary reading to psychology and to ethics. Smith devotes the preface of his The Philosophy of David Hume (1941) to a revision of his 1905 study. It seems he did not alter his attitude towards the first part but only to the second: he thought the starting point of Hume's study was his concern not for "naturalism" but for "moral philosophy, or the science of human nature" (opening words of Hume's Inquiry, cf. Hendel, op. cit., p. xlvi). This statement has to do 94 with emphasis, not with the meanings of terms or with ascriptions of views (and it is erroneous, or at least limited; but this is another matter).
